Just need OFF's input on this. a month ago...I saw a guy sliced open a salmon for eggs...one salmon. He has every right to do it because he caught it. He put the salmon on the black garbage bag and threw it on a garbage bin. Then 2 weeks ago I spotted a guy caught a salmon...squeezed the eggs out and let the salmon go. Which is the way to go? Just asking.

you can only squeeze the eggs out if they are loose, the one that he cut, the eggs were in the skein, if the eggs are loose then of course just squeeze them out, it is also easier to cure them, just dip them in the river water for about 15 minutes and tie them up! the salmon are most likely spawned out right now, but if you are lucky enough to catch a female, it should still have some eggs inside, if you catch a salmon with eggs still in the skein, witch i doubt at this point will happen, but maybe a coho, then bleed the fish and then gut it, but dont throw the salmon out, take it home, or give it to someone at the river, i usually give mine to some guy that wants the fish, there is usually some guy that wants the fish, i say now when i get a steelie but with an old salmon, he can knock himself out, lol!

it is 100% illegal to kill a fish for eggs and throw the body away, that is called poaching. now as he said, either guy was a major nether orifice or she was not loose, or he didn't know you could milk the eggs out by squeezing. now if you squeeze the eggs out of the female salmon, it counts toward your daily fish count and also counts as animal molestation, but there is no law against it though. at least you don't have to kill the fish and then need to throw it away if no one eats it. nature will take it's course regardless.

not poaching, but allowing the meat to spoil is against the law, when i was fishing with roe, i would keep one female, my buddies dog ate well for a few days

good question! I've often wondered this myself as I see dead gutted salmon on the bank. Just seems soooo illegal!

I thought you're not allowed to forcefully milk out a salmon but rather just tilt it and let the loose eggs drip.
If it is milked it goes towards your limit?

whether your tilt it and squeeze it, you are milking it, you are just justify your action, once you drain it you start the death clock on it faster. YES it counts toward your daily limit, since you pretty much killed it. little different for trout, but still counts toward you daily limit. it is not illegal but it is considered animal molestation.

Please provide a link to the piece of legislation that makes this act animal molestation. Please provide case law where charges have been laid, and a conviction entered. Thanks, i am very interested.

my understanding is that you can toss the salmon after taking the eggs providing it's not safe for human consumption. The eggs would count towards your limit for the day. I dont fish with roe so i've never bothered to actually verify that.

there is no law, there is no legislation. that is why you can do it. it is no different than milking a wild animal for milk.

That is precisely my point. Stripping and releasing a fish is NOT illegal, and does NOT constitute "molesting" a fish. It is completely legal, and there is no basis in law currently for anyone to be charged. Anything else is purely opinion and conjecture. Now if you stripped a fish with your knee, kept it out of the water for a long time, and then released it downstream floating belly up, you would likely be charged if the offence was observed, but more probably with a wanton waste type offence as there is no charge for releasing a stripped fish. That charge however, would also have to be proven in court if it was disputed.

I've had this conversation with CO's. It is not illegal to gut a fish for eggs and ditch the carcass, I thought it would be, so I asked a warden, he told me if the fish is considered inedible or toxic (pretty much any lake O fish of size) then it is not illegal. But he also stated that it is kind of a loop hole because it is to the anglers discretion. He also said salmon are only in our lakes in rivers for recreational fishing, and basically told me in a polite way he didn't give a $&@$ what happens to them. Lol

maybe he doesnt, but the ministry does, why do you think they stock them? the co you got was not very responsible if he said that, did he think about the people who live near the river and have to smell that $hi! everyday, probably not, point is, it is against the law to throw out a WHOLE fish and just take the eggs.

But it's not against the law, we had this discussion last year on this forum, I'll try and find the article. And this was on a GB trib, we get no help with stocking lol.
