My brother and I are having a debate over whether or not the fish I caught was a muskie or a pike please help

In certain zones, that is considered a keeper Musky. It looks better than 40" and should be over most of the size limits for Musky.
But your sentiment is well taken. If you are uncertain of the species, the right course of action is to release the fish.
