Snagging is NOT a crime, he would have to prove they were either killing the fish/ intent to take it out of the waters is what the crime is. It isnt poaching till the fish is in a bag/bucket or cut open.

A CO or any person can witness a fish being snagged and dragged to shore, once the fish is released there is nothing legally that can be done.
Morally I think it is wrong, and very poor sportsman ship to snag at all. I understand the occasional foul hook. I am talking about those guys with 20lbs line and yanking lines.
 
To further all that, the ONLY time a car/properties will be siezed is if the fines amount to something that is deemed "un satifiable"
For example

$300 fine for every poached fish
offender has 20 fish.
the fine is $6000

The CO can sieze but not destroy the property untill the debt is satisfied.

For people who snag, its a ticket. Poaching they can issue tickets, if it seems to be a repeat offender they can take thier rods/equipment used to commit the crimes and THATS IT!

I think it is. Says so in the "GENERAL PROHIBITIONS – IT IS ILLEGAL TO:" section. I asked a CO about snagging and he also confirmed that it is illegal to intentionally snag fish.

This is why when you go into stores that use survielence cameras they will ALWAYS have a sign saying you are on video or CCTV in use.
You will find yourself in alot more trouble and the evidence is INADMISABLE into any kind of evidence.

Educate yourselves, take pictures of thier car, licence plate, time stamps, gps locations ect.

So upsetting to read over and over again.

^This isn't completely true. It's not illegal to take pictures of people in a public area without their permission as long as it's not for advertising purposes.
 
you have the legal right to take pictures of people that you know are breaking the law--as well as you are allowed yo conduct a citizens arrest...both of which are legal. and if someone is breaking the law you can bet your balls those pics will be used in a cout of law--against them

Trust me snagging intenionally is frowned apon but NOT illegal. Its when you keep the fish and not release it, that the act becomes illegal.

Good luck Chaka! Good luck. Check out laws governing the admission of pictures into courts.
 
Went to one of the western river on Monday. Saw two old Asian men snagging. One guy that was fishing across from me saw that the two was hooking on to a lot of fish, so he decided to put on a treble hook and do the same. More people came and they all started to do the same. I just got disgusted and left. Monkey see, monkey do. I'm just so surprised that the COs, knowing the amount of fishermen that fish this time of year, would not patrol the rivers more. I know they can't patrol all rivers, but a least the most busy ones. I'm sure if a CO came by that day, he would have made his daily quota in that one spot.

Technically, arent you already breaking the law by simply being near the water with a snagging hook, regardless whether you snag or not? At least thats the impression im getting from it.
 
Bc Treble hooks are legal in most rivers, "Snagger" that is a suggestive work with no diffinitivies.

So A snagger to some maybe 20lbs line with a treble
to other a guy with 8lbs line and mepps is a snagger.
How to quantfy this?
 
I mean a gaf hook on a mountain climbing rope is commonly used in salt water applications

That there to anyone is a snagger.
 
Some of it is open to interpretation by the officer. Having just a plain treble hook at the end of a line often results in a fine on tributaries.
 
Treble hook once baitied and not using channel wieghts, its all at the descretion at the officer like you said.
 
It sucks this happens every year... But on a positive note I came across an mnr officer 3 times this year checking licenses on the river and at the piers... maybe all this whining is being heard who knows but it is nice to atleast see them once in a while thanks for the effort.
 
hate to break it to you guys but the mnr no longer gives a single fuck about chinook with the hopeless salmon restoration project
 
at some point going to review the Harper Government's new law's on citizens arrest... maybe you can play volunteer MNR officer?
 
they have to be caught in the act or without licenses or over their limit to get charged.

Call the MNR, when they say they can't make it tell them you are going to call the local cops.

It's a criminal offense

First you "just" left out of anger, then later in your "story" you make a video, confront them and get some nonsense answer from them? C'mon man. The holier than thou types here are killing me. You guys are ALL flossing salmon. You're snagging them in the mouth. They are NOT feeding, they don't hit your roe bag that you drift down the middle of a pool holding tons of huge half dead fish with their mouths open. Who cares if you don't slit them open for roe? Most of them die shortly after from the exhaustion and stress you just put them through. Don't get me wrong, I've fished for and caught plenty of them this way. But this year was too much of an eye opener. The stench alone turned me off. I'm waiting for steelhead from now on.
