The town does not own the river bottom, the province does, which means it's public. Can't be charged if you are in a boat, or standing in the river.

Way too late, water will be back down long before then. Lower Bronte is mostly clay, when it rains it flows hard and levels drop quick.

I somehow don't believe that, if it was warmer i would think so but with the cold whether i think it will stay the same almost. Have you seen it lately?

even if it does go down all the pools will be packed? noo?
 
would the creek still be good for fishing in like... 2 or 3 weeks from now?
or will i just be wasting my time?
 
The river has already dropped a few centimeters, and the water has cleared up significantly. The bite was not anywhere's near as good yesterday, and the number of fish moving upstream visibly dropped all day long! Now you have to find the good spots, and once you do everyone will move in as soon as you hook up! I had people move in on my spot when I had to re-tie from a snag, and another guy move in again when I pulled my line from the water as the guy just up from me had one on. Certainly not much fishing etiquette in the GTA.

I think the river bottom is owned by the province. There was a similar situation on the Upper Credit. A landowner had strung a "No Trespassing" sign across the river. I wrote to the MNR to complain and have it removed. They answered and said they would not - I guess the owner was well connected. Drove by there today - it's now posted on the river bank, so something happened there.If you're in the riverbed, I think you're okay. Sounds more like a bogus charge to me anyway... how can you charge a citizen with trespassing in a park? That makes no sense at all.
Isn't this an election year?
 
A lot of old land sales/leases that the government did back in the day included the land that went under rivers. Some family friends were walking in a river where we fish and were asked to not go past a certain point because it's ''private property'' and they persisted that you can't own the river, well the conservation officer said they technically own the land bedding the river.. so he asked if he could come back with a kayak and he'd be in the clear.. it's perfectly legal regardless if land on both sides of the river + underneath is owned, just use a flotation device/boat/kayak or whatever and nothing can be done about it(for that situation anyways, not about parks or such). :lol:
 
the next few days there may be some rain, I know for a fact the number of salmon in the river was much more than last week
 
Yanni, I think the CO is stretching things a bit there. Riparian rights give land owners adjacent to public waterways shared use of the waterway for personal reasons, not exclusive use. This law goes back to 1867.

History
In 1867, with the signing of the Constitution Act, provinces were granted rights to manage waters contained within their boundaries on a day-to-day basis. This remains a very complicated process with roles and responsibilities split between federal, provincial and municipal levels of government.
In Ontario our water management system is founded on English (British) common law principles where water is typically viewed as a ‘common good’ and is therefore not subject to “ownership” as other goods unless bottled and/or contained and sold as a commodity.
English common law stated that only people whose land adjoined a watercourse (riparian owners) had rights to use water for domestic and livestock purposes and a restricted right to use water for other purposes(e.g., irrigation, industry) provided these uses:
•did not noticeably alter the quality or quantity of its natural flow;
•did not affect rights of other riparian owners;
•were reasonable use for extraordinary purposes balances the rights among all riparian owners on the watercourse;
•were not transferred to non-riparian’s; and,
•conform to modifications as dictated by statute laws (e.g. Section 34 of Ontario Water Resources Act governing permits to take water)

Regardless, charging people with trespassing for fishing means the no fishing rules are unenforceable. I owned 21 acres out by Belleville, and there was a creek running through my property. I could not build anything or even change the landscape (cut trees, ect.) within 200' of the creek bed - designated environmental protection - even though I paid the taxes. If anything, public waterways and access work against the owners with respect to trespassers. It's usually ignorant slobs that cause landowners to be aggressive. Most couldn't care less as long as you don't disturb things and leave no garbage behind.
 
If you really want to cause a stir, take your trespassing charge to court with a native lawyer!

According to the 2010 Ontario fishing rules, and regulations guide, this section of the river IS OPEN to fishing, and the cops are wrong in charging people! Seems they need to read up on the laws they enforce!

Take thoe book with you, and have that section highlighted to show the cops if you get hasseled!
It has nothing to do with the sanctuary. The town of oakville made it so it is trespassing to fish there .

when i got there someguy told me theres no fish there what so ever and trying to make me go home thinking i was some stupid teen so i start walking and right away i started seeing fish at petro then i walk up to the first big pool and there was 8-7 immigrants fishing with llike 40 pound test huge lead weights and you couldnt even drift i tried and first drift i hooked on to one of their lines!! but i seen a lot of fishing swimming in that pool. i went up a little bit started drifted and i hooked on to a 25+ chinny but my line snapped bcuz he went under a log and i use a really light set up. 6lb main line 4lb floro leader! and anyways thats it i was only there for an hour tho
 
I was at the creek today, and only caught chub. The water is down, and very clear. The fish are in pools, and very hard to catch. You need to be patient, watchful, and quiet. I was fishing a pool behind a log jam where there were a few fish. Some dummies came walking up behind the pool, up on the bank then back in to the water above the log, and muddied it up! The fish went under the logs, and held there for quite a while. I walked a long way today, saw some fish, saw a 2 rough salmon caught, and that was about it.

really i was there today and i seen a lot of fish! i started at petro at 630 in the morning and there was a brown bugging a salmon man the colours on that thing! but at petro there wasnt to much fish so i drove up to the qew and walked up! almost every pool there was like 3-6 fish!
